Public domain – pleasure and profits

Public domain: yes or no?

You can ask: why are there so many good creations which I can use for free? The reasons are different. These works were either published before January 1, 1923. Or their copyright expired. (But notice that the creations which were not published before 1923, they are still under copyright during the life of its author plus 70 more years (70 – in the USA)).

Besides, these works were not eligible for copyright. Or they are governmental creations (except those which were/ are produced by contractors for the government). The creations which came to life after 1978 are automatically covered by copyright.

Those creative works which were published or just registered between 1923 and 1964 – they had to be renewed within 28 years. Otherwise their copyright certainly expired. So, logically, those authors who did not care about their copyright – in 28 years they mechanically put their creations into the public domain. And the amount of such creative works without renewed copyright is gigantic (except most films, music, maps, etc). Therefore this is a good news for us, if we find these works!

One more thing has to be added here. If you are not a citizen of the USA (and presumably you want to use namely the public domain of America), you have to obey the laws, copyright rules and regulations of both countries – your own and the foreign one. Always check international treaties and agreements as well. And do not get disappointed if your local regulations are stricter than theirs. You can still benefit from those American public domain creations, which are allowed to utilize by your native laws.
